1. Acceptance of Terms

By accessing or using the website at highdevel.com or engaging HighDevel Engineering Studio ("HighDevel", "we", "us", "our") for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or our services.

2. Services

HighDevel provides product engineering and software consulting services including, but not limited to, SaaS platform development, enterprise software, web and mobile application development, API design, cloud infrastructure, and technology consulting ("Services").

The specific scope, deliverables, timeline, and pricing of any engagement are defined in a separate written agreement (such as a Statement of Work or Service Agreement) entered into between HighDevel and the client. These Terms of Service apply in addition to, and do not replace, any such agreement. In the event of a conflict, the terms of the specific Service Agreement shall prevail.

3. Website Use

You may use this website for lawful purposes only. You agree not to:

• Use the site in any way that violates applicable local, national, or international law
• Transmit unsolicited or unauthorised advertising material
• Attempt to gain unauthorised access to any part of the site or its related systems
• Scrape, crawl, or harvest data from the site through automated means
• Submit false, misleading, or fraudulent information through our contact forms

4. Intellectual Property

Our content

All content on this website — including text, graphics, logos, and design — is the property of HighDevel and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any site content without our prior written consent.

Work product

Intellectual property rights in deliverables produced as part of a client engagement are governed by the applicable Service Agreement. Unless otherwise agreed in writing, upon receipt of full payment HighDevel assigns to the client all rights in custom deliverables created specifically for that client. HighDevel retains ownership of all pre-existing intellectual property, general methodologies, frameworks, and reusable tooling ("Background IP").

5. Confidentiality

Any information you share with us during the inquiry or engagement process — including project details, business requirements, and technical specifications — will be treated as confidential. We will not disclose your information to third parties except as required to deliver the Services or as required by law.

Formal confidentiality obligations for client engagements are set out in the applicable Service Agreement or Non-Disclosure Agreement.

6. Disclaimer of Warranties

This website is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

HighDevel does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by applicable law, HighDevel and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount paid by you to HighDevel in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.

Our website may contain links to third-party websites. These links are provided for convenience only. HighDevel has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites.

9. Indemnification

You agree to indemnify and hold harmless HighDevel and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of this website, your violation of these Terms, or your infringement of any third-party rights.

10. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the website, the parties agree to first attempt to resolve the dispute informally by contacting us at hello@highdevel.com. We will make a good faith effort to resolve the issue within 30 days of receiving written notice.

If informal resolution fails, either party may pursue their rights through the courts as set out in Section 11. Nothing in this clause prevents either party from seeking urgent injunctive relief where necessary.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain, without regard to conflict of law provisions. Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts of Spain.

Where you are a consumer located in another EU member state, you retain the benefit of any mandatory consumer protection provisions of your local law that cannot be contractually waived. For disputes with EU consumers, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

12. Force Majeure

HighDevel shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, government action, power outages, internet or telecommunications failures, or third-party service disruptions.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the website after changes are posted constitutes your acceptance of the revised Terms.

14. General Provisions

• Severability — if any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect
• No Waiver — our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights
• Entire Agreement — these Terms, together with any applicable Service Agreement, constitute the entire agreement between you and HighDevel regarding the subject matter herein and supersede all prior discussions and agreements
• Assignment — you may not assign or transfer your rights under these Terms without our prior written consent. HighDevel may assign these Terms in connection with a merger, acquisition, or sale of assets
